These Terms of Service (“Terms”) govern your use of www.elyvatewellness.com  and Elyvate Wellness services, including 1-on-1 coaching, digital courses, and the Elyvate community (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

1) Business Information

Elyvate Wellness is a sole proprietor operating as a DBA (“doing business as”) under the name Elyvate Wellness.

2) Eligibility

You must be 18 years or older to purchase or participate in the Services unless a parent or legal guardian is present and responsible for the minor’s participation.

3) Wellness Disclaimer

Elyvate Wellness provides educational information and coaching support. We do not diagnose, treat, cure, or prevent medical conditions, and we are not acting as your doctor or licensed healthcare provider (unless explicitly stated in writing).

Always consult a qualified healthcare professional for medical concerns. Do not stop or change medications without medical supervision.

4) Accounts and Access

You may need to create an account (via Kajabi) to access purchased content. You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account. You may not share access to paid products unless explicitly allowed.

5) Purchases, Payments, and Billing

A. Payments
Payments may be processed through Kajabi and/or Stripe. If you choose a payment plan option, financing may be provided by Affirm (subject to Affirm’s approval and terms). Third-party processors handle sensitive payment information; Elyvate Wellness does not store full payment card numbers.

B. Subscriptions
If you purchase a subscription (for example, community access), you authorize recurring charges at the stated interval until canceled.

Cancel anytime: You can cancel your subscription at any time. Access continues until the end of your current billing period unless otherwise stated at checkout.

C. No refunds
All sales are final. Elyvate Wellness has a strict no-refund policy for coaching, digital courses, community subscriptions, and any other purchases unless otherwise required by law or explicitly stated in writing.

6) Coaching Policies (1-on-1)

Specific scheduling, rescheduling, and session policies may be described at checkout, in your coaching agreement, or in onboarding materials. You agree to follow those policies as part of the Services.

7) Intake Forms and Client Responsibility

You may be asked to complete intake forms and questionnaires to support coaching and personalization. You agree to provide accurate information and acknowledge that outcomes depend on many factors including your participation, consistency, and individual circumstances.

8) Community Standards

If you participate in the community, you agree to:

• Communicate respectfully and avoid harassment, hate speech, or harmful conduct

• Not post illegal, abusive, defamatory, or infringing content

• Not share other members’ private information

• Not solicit, spam, or promote unrelated products/services without permission

We may remove content, restrict access, or terminate accounts for violations.

9) Intellectual Property

All content, materials, programs, courses, downloads, videos, text, branding, trademarks, and community resources are owned by Elyvate Wellness or licensed to us. You are granted a limited, non-transferable license for personal, non-commercial use only.

You may not copy, reproduce, redistribute, resell, or create derivative works from our content without written permission.

10) User Content License (Community)

If you post content in the community, you grant Elyvate Wellness a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content for operating and promoting the Services. If you want a specific post removed, contact support and we will make reasonable efforts to comply where feasible.

11) Prohibited Use

You may not:

• Use the Services for unlawful purposes

• Attempt to hack, disrupt, or reverse engineer the Site or platform

• Upload malware or malicious code

• Impersonate others or misrepresent affiliation

• Share paid access credentials or pirate content

• Use our Services to provide competing services using our proprietary materials

12) Third-Party Services

The Services may rely on third-party platforms (including Kajabi, Stripe, Affirm, and Google Calendar integrations). We are not responsible for third-party downtime, policies, or acts/omissions.

13) Disclaimer of Warranties

The Services are provided “as is” and “as available.” We make no guarantees regarding results, outcomes, or uninterrupted access. Results vary by individual and depend on many factors outside our control.

14) Limitation of Liability

To the maximum extent allowed by law, Elyvate Wellness will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits/data arising from your use of the Services.

If Elyvate Wellness is found liable for any claim, our total liability will not exceed the amount you paid to Elyvate Wellness in the six (6) months prior to the event giving rise to the claim.

15) Indemnification

You agree to indemnify and hold harmless Elyvate Wellness from claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from your misuse of the Services, your violation of these Terms, or your infringement of any rights of another.

16) Termination

We may suspend or terminate your access to the Services if you violate these Terms, misuse the Services, or engage in harmful conduct. No refunds will be issued upon termination.

17) Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules, unless otherwise required by applicable law.

18) Updates to These Terms

We may update these Terms from time to time. Continued use of the Services after changes means you accept the revised Terms.
